The framework does not create new law. It is a blueprint — a set of six guiding principles the White House wants Congress to turn into legislation "this year." But the principles are specific enough, and the direction clear enough, that developers and AI companies can start reading the regulatory environment they are going to be operating in.

Why This Framework Exists Now

The context matters. In December 2025, Trump signed an executive order blocking states from enforcing their own AI regulations, citing a "patchwork of 50 different state regulatory regimes" that "threaten to stifle innovation and jeopardize America's lead in the AI race."

That executive order was a temporary measure. Executive orders can be reversed by the next administration and challenged in court. The White House wants Congress to codify the same principles into federal law — creating a permanent, binding national framework that explicitly preempts state-level AI regulation.

The timing is also a direct response to the EU's AI Act, which began enforcement in 2024 and creates detailed compliance obligations for AI systems operating in Europe. The Trump framework takes the opposite posture: the EU model is explicitly what the US does not want to replicate.

The Six Guiding Principles

1. Protecting children and empowering parents

Congress should give parents tools to manage children's digital environments and device use. This includes provisions around AI-generated content targeting minors, age verification in AI-powered platforms, and parental controls over AI interactions. This is the one area where the framework accepts meaningful regulation — children's safety is the carved-out exception to the light-touch approach.

2. Safeguarding and strengthening American communities

AI development should produce economic growth and energy dominance. The framework calls on Congress to streamline permitting so data centers can generate power on-site — a direct response to the AI energy crisis where new data center construction is bottlenecked by grid connection waiting times measured in years. This provision is as much energy policy as AI policy.

3. Respecting intellectual property rights while protecting free speech

This is the most contested principle. The framework acknowledges that "the creative works and unique identities of American innovators, creators, and publishers must be respected" — but immediately pairs this with "AI must be able to make fair use of what it learns." The White House is proposing that Congress find a middle path: some form of copyright protection for training data use, but not a blanket prohibition that would make training frontier models on internet-scale data illegal.

This principle will be fought over intensely. Publishers and creators want compensation for training data use. AI companies want broad fair use. The framework says both things simultaneously and leaves the resolution to Congress.

4. Enabling innovation and ensuring American AI dominance

States "should not be permitted to regulate AI development." Companies "should not unduly burden Americans' use of AI for activity that would be lawful if performed without AI." AI developers "should not be penalized for a third party's unlawful conduct involving their models."

This last point is particularly significant for developers. It means the framework explicitly rejects liability for AI providers when users misuse their models for illegal purposes. The model provider is not responsible for what the model is used for — a direct parallel to Section 230 protection for internet platforms.

5. Educating Americans and developing an AI-ready workforce

The framework calls for curriculum changes at the K-12 and higher education level, AI literacy programmes, and workforce retraining programmes for workers displaced by AI automation. This is the acknowledgment inside the framework that AI will displace jobs — and the political answer to that acknowledgment is retraining, not restriction.

6. The regulatory sandbox provision

The framework calls for establishing regulatory sandboxes — designated environments where developers can test AI applications under relaxed regulatory rules. Sandbox participants would be exempt from certain compliance requirements during testing phases, allowing experimentation that current regulations might prohibit or require extensive pre-approval for.

What the Framework Does NOT Do

The White House is explicit that preempting state laws does not mean eliminating all state powers over AI.

States can still enforce general laws against AI developers — child protection laws, fraud statutes, and consumer protection regulations apply regardless of this framework. The federal preemption is specifically targeted at state-specific AI regulations — laws that create AI-specific compliance obligations or restrictions that go beyond what general law requires.

The framework also explicitly does not create a federal AI regulator. There is no proposed US equivalent of the EU's AI Office. Enforcement of the eventual legislation would flow through existing agencies — FTC, DOJ, FCC — rather than a new dedicated AI authority.

US vs EU: The Explicit Contrast

EU AI Act approach: Risk-based classification system. High-risk AI applications (healthcare, hiring, critical infrastructure, law enforcement) face mandatory conformity assessments, transparency requirements, human oversight obligations, and registration in a public database before deployment. Fines up to 7% of global annual turnover for violations.

Trump framework approach: No risk classification. No mandatory pre-deployment assessments. No AI-specific regulator. Regulatory sandboxes instead of pre-deployment review. State law preemption to create a single unified national framework instead of 50 different ones. Liability protection for model providers on third-party misuse.

For a developer building an AI application:

  • EU deployment requires compliance with risk categorisation, documentation, and potentially registration
  • US deployment (under the eventual legislation) would require compliance with general law (existing fraud, consumer protection, child safety regulations) but not AI-specific obligations beyond those

The practical consequence: if this framework becomes law, the US becomes significantly easier than the EU to deploy AI applications in. Companies that have been paralysed by EU compliance uncertainty will have a cleaner US-first path.

What Developers Need to Watch

The framework is a blueprint, not law. Congress has to act. And Congress acts slowly.

The White House pushing Congress to act "this year" (2026) is aspirational. The legislative process for AI — involving competing interests from publishers, tech companies, state governments, and civil liberties groups — is not going to resolve in a few months.

What is more immediately actionable is the executive order already in effect: states cannot enforce state-specific AI regulations while the executive order stands. That provides immediate legal relief for companies that were facing Colorado, California, or Illinois AI-specific compliance requirements.

The regulatory sandbox provision is worth watching closely. If Congress creates sandboxes, they will likely be administered through existing agencies — FTC or NIST. Getting into a sandbox early gives access to regulatory relationships and potentially early compliance credits that are valuable when the eventual legislation does pass.

The copyright fair use principle — AI training on internet-scale data treated as fair use — is the provision most likely to face legal challenge. Multiple ongoing court cases (The New York Times vs OpenAI, authors' class actions vs image generators) are testing exactly this question. The framework signals which way the executive branch wants the law to go, but the courts will have independent views.
